Who is the Data Controller of your personal data?

The personal data that you voluntarily provide to us will be processed in accordance with the provisions of Regulation (EU) 2016/679 of the General Data Protection Regulation (GDPR) and the Spanish Organic Law on Personal Data Protection and Guarantee of Digital Rights, together with the rest of the applicable implementing regulations, and will be included in a file whose Data Controller is J.S.T. For what purposes?

On the website www.jst.es, data may be collected from users who voluntarily provide it through the “contact” form or the “sample request” form. In such cases, J.S.T. ESPAÑA, S.A. will collect and process the information provided solely and exclusively for the purpose of responding to the user’s enquiry or request, with the corresponding follow-up. At no time will J.S.T. ESPAÑA, S.A. send newsletters.

How long do we keep your data?

The personal data provided will only be retained for as long as we are handling your request and the corresponding follow-up that motivated you to contact us, which will never exceed one year from your request or last interaction, unless you previously withdraw your consent or exercise your right to object and/or request erasure, or for as long as liabilities arising during this period may exist (see section Whatare your rights).

In any case, if the user withdraws consent, exercises the rights of erasure or deletion, or once the aforementioned retention period has elapsed, personal data will be blocked for the periods established in order to address any potential liabilities arising from their processing. Subsequently, the data will be deleted using appropriate security measures to ensure their anonymisation or complete destruction.

What is the legal basis for processing your personal data?

The legal basis for processing the data you provide to us is the consent requested from you. Please note that you may withdraw the consent you have given at any time (see section Whatare your rights).

In all forms, only the fields marked with an asterisk (*) are mandatory in order to process the user’s request. Any additional information provided will be at the user’s discretion.

To whom will the data be disclosed?

Recipients: The personal data provided by users of the website www.jst.es to J.S.T. ESPAÑA, S.A. will not be transferred to third parties, except where required by law.

Data Processors: Access to the data may be granted to service providers of J.S.T. ESPAÑA, S.A. who provide auxiliary services necessary to fulfil the purposes for which the data is collected. Such access shall not, under any circumstances, constitute a transfer of the data. In any case, we inform you that, where applicable, a data processing agreement is always formalised with these providers (Data Processors), setting out the obligations and responsibilities they must assume when processing the data, in accordance with applicable data protection regulations.

As a service provider, J.S.T. ESPAÑA, S.A. informs you that the data provided by users on the website is processed and hosted on a German web server, which, as it is located within the European Economic Area, guarantees an adequate level of data protection.

Mandatory disclosures: In cases where disclosure is required by law or by judicial order, J.S.T. ESPAÑA, S.A. shall communicate your data to the entities determined by such legal obligation.

What rights do you have when you provide us with your data?

Rights: Users of www.jst.es may exercise before J.S.T. ESPAÑA, S.A. their rights of access, rectification or erasure, data portability, restriction or objection to the processing of their data, as well as withdrawal of consent, where it has been granted.

If we have doubts about your identity, we may request additional information in order to verify it and thus prevent unauthorised access to your data by third parties. If you believe that your rights have not been properly satisfied, you may lodge a complaint with the Spanish Supervisory Authority, the Spanish Data Protection Agency (AEPD), at www.aepd.es.

Technical, organisational and security measures:

The website www.jst.es declares that it has adopted appropriate technical, security and organisational measures to ensure a level of security appropriate to the risk, as required by Regulation (EU) 2016/679 (GDPR) and the Spanish Organic Law on Personal Data Protection and Guarantee of Digital Rights, together with the rest of the applicable implementing regulations, in order to prevent loss, misuse, alteration, unauthorised access or theft of the data you provide.

However, the user should be aware that current Internet security measures are not impregnable and, therefore, absolute protection against illegal or improper intrusions cannot be guaranteed. Such intrusions would not be the responsibility of J.S.T. ESPAÑA, S.A., as it has acted with due diligence to protect data in accordance with the law.

Changes to the Privacy Policy

J.S.T. ESPAÑA, S.A. reserves the right to modify this policy at any time. We recommend that you review the Privacy Policy periodically. Where applicable, J.S.T. ESPAÑA, S.A. will take reasonable steps to notify you of any material changes to our privacy practices relating to the use of the information you have provided, in all cases by publishing them on the website, from which time the user shall be deemed to have been informed.

User Commitment:

The user is responsible for the authenticity of the data provided, as well as for its accuracy and validity for the purpose for which it was supplied, and assumes liability for any damages and losses, including both loss of profit and actual damages, that may arise as a result of any inaccuracies or false statements.

In any case, if the data provided in the corresponding forms belongs to a third party, the user guarantees that they have informed said third party of the aspects set out in this Legal Notice and Privacy Policy and that they have obtained their authorisation to provide the data to J.S.T. ESPAÑA, S.A. for the purposes indicated.

For all these reasons, J.S.T. ESPAÑA, S.A. will make every reasonable effort to ensure that the data provided is always kept up to date. However, responsibility for the quality of the data rests with the data subject. Therefore, if any changes occur, the website user must notify the Data Controller accordingly, who shall decline all liability in the event that the user fails to fulfil their obligation to report such changes.
